By accessing or using Overture ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
If you do not agree to these Terms, do not use the Service.
Overture is built and operated by Polsia. References to "Overture," "we," "us," or "our" refer to Polsia operating the Overture service.

The Service is designed for B2B sales use cases. Use for consumer outreach, spam, or any purpose that violates applicable laws is prohibited.

Overture offers a 14-day free trial with no credit card required at sign-up. During the trial period:
Overture is offered on a monthly subscription basis:
A launch promotional rate of $199/month (for the first 3 months) was available to subscribers who signed up before April 9, 2026. That promotional period has ended; existing subscribers on that rate remain grandfathered per the terms at the time of sign-up.
Prices are in USD and exclude applicable taxes. We reserve the right to change pricing with 30 days' notice to active subscribers.
Subscriptions are billed monthly on the anniversary of your subscription start date. Your first paid invoice is due at the end of your free trial period (if applicable) or immediately upon subscribing.
We accept major credit cards and payment methods supported by our payment processor (Stripe). By providing a payment method, you authorize us to charge the applicable subscription fees.
If a payment fails, we will attempt to retry the charge. After multiple failed attempts, your account may be suspended. You are responsible for keeping your payment information current.
You may cancel your subscription at any time through your account settings or by contacting support@overture-22.polsia.app. Your access continues until the end of the current billing period. We do not prorate partial months.

You are solely responsible for ensuring your outreach campaigns comply with all applicable laws and regulations in the jurisdictions where your prospects are located. Overture provides the tools; the legal compliance of how you use them is your responsibility.
You retain ownership of all data, ICP configurations, and materials you provide to Overture ("Your Content"). You grant us a limited license to use Your Content solely to provide the Service to you.
You represent and warrant that Your Content does not violate any applicable law or third-party rights, and that you have all necessary rights to provide it to us.
Overture generates email copy and other content using AI on your behalf. You are responsible for reviewing this content before it is sent and ensuring it meets your standards. We do not warrant that AI-generated content will be accurate, complete, or appropriate for all recipients.
The Service, including its software, design, and all associated intellectual property, is owned by Polsia. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, reverse-engineer, or create derivative works from any part of the Service without our express written consent.
The Service integrates with third-party services including Google Calendar, Microsoft Outlook, and prospecting data providers. Your use of those integrations is also subject to those providers' terms of service. We are not responsible for third-party services or their availability.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will meet your specific business objectives, that AI-generated outreach will produce any particular results, or that all prospect data will be accurate or up to date.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVERTURE AND POLSIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Polsia, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any outreach campaigns you conduct using the Service.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association. You waive any right to a jury trial or class action.
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, cancel your subscription before the effective date.
We may suspend or terminate your account immediately if:
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.
